On the basis of Act No. 171/2023 Coll., on the Protection of Whistleblowers (hereinafter the “Act”), LB MINERALS, s.r.o. has established an internal whistleblowing system intended for natural persons who, in connection with work or other comparable activity, have learned of possible unlawful conduct that breaches a legal regulation falling within one of the areas defined by the Act.

A person who has reasonable grounds to believe that the reported information about a breach was true at the time of the report and that this information fell within the scope of the Act, and who submits a report in accordance with the Act through the internal or external whistleblowing system, will be granted protection within the meaning of the Act. This protection consists, for example, in the prohibition of retaliatory measures against the whistleblower and other natural and legal persons (e.g. colleagues, the whistleblower’s assistants, persons close to the whistleblower, etc.). Protection does not, however, extend to a person who made a report without having reasonable grounds to believe that it was based on true information (a knowingly false report). Confidentiality will also be ensured with regard to the identity of the whistleblower (and any other persons concerned) and to the information contained in the report.

In accordance with the Act, LB MINERALS, s.r.o. accepts reports only from whistleblowers who perform work or other comparable activity for the company, by which is meant:

  • dependent work performed in a basic employment relationship,
  • voluntary activity,
  • professional work placement or internship, including applying for such work.

The acceptance of reports from persons other than those listed above is excluded.

Within the meaning of the Act, only conduct may be reported that

  • bears the characteristics of a criminal offence,
  • bears the characteristics of an administrative offence for which the law sets a fine whose upper limit is at least CZK 100,000,
  • breaches the Act, or
  • breaches another legal regulation or a regulation of the European Union in the area of: financial services, statutory audit and other assurance services, financial products and financial markets, corporate income tax, the prevention of money laundering and terrorist financing, consumer protection, compliance with product requirements including product safety, the safety of transport, carriage and traffic on roads, environmental protection, food and feed safety and the protection of animals and their health, radiation protection and nuclear safety, competition, public auctions and public procurement, the protection of internal order and security, life and health, the protection of personal data, privacy and the security of electronic communications networks and information systems, the protection of the financial interests of the European Union, or the functioning of the internal market including the protection of competition and State aid under European Union law.

Ways of submitting a report

1) Internal whistleblowing system

A report may be submitted by e-mail to oznameni@lb-minerals.cz, or in writing to the address LB MINERALS, s.r.o., Mr Ing. Pavel Bárta, Managing Director, Tovární 431, 330 12 Horní Bříza; mark the envelope: “DO NOT OPEN – intended solely for the addressee named above”, or by telephone (orally) on +420 734 315 622, or in person (orally or in writing) by prior arrangement with the person responsible for receiving and handling reports. The person responsible for receiving and handling reports is Mr Ing. Pavel Bárta, Managing Director, whose contact details are given above.

2) Group whistleblowing system
